General conditions of sale on line

The following provisions establish the general conditions of sale of the products offered by Cartronics on its web site at the following address: http://www.cartronics.be

All orders placed through this site imply the acceptance of these general conditions of sale by the customer or user.

The parties agree that their relationship will be governed exclusively by the present contract, to the exclusion of any conditions previously available on the site.

Order

The user has the opportunity of placing an order via le site www.cartronics.be by completing the on-line order form following the allocation of a customer number that will be issued by the Customer Relations Department after the first order.

The order transmitted through the site is not binding on Cartronics until it has issued express written confirmation (despatch email). The information provided on its site can never constitute a contract proposal such that the simple desire expressed by the purchaser to acquire the products can give rise in itself to a contract.

Any order amendments shall only take effect after written approval of Cartronics through a mail confirming despatch. They may only be accepted to the extent that the supply of the equipment and/or services has not commenced, wholly or in part. Where applicable they may give rise to an increase in the prices charged.

No cancellation of a confirmed order, wholly or in part, can be accepted without the express written agreement of Cartronics. In this event, Cartronics will invoice 30% of the amount of the cancelled order with a minimum of €100 as recompense for the loss and expenses occasioned by the cancellation, without prejudice to the right of Cartronics to claim higher damages through the courts.

Cartronics reserves the right to refuse an order if the price and/or the specifications of product mentioned on the web site are incorrect due to technical failure or human error.

Prices and payment conditions

The prices listed on the web site include VAT. Current prices are valid the day of the order through the site.

Prices and promotional offers applicable are those announced on the site, to the exclusion of any prices and promotional offers applied or displayed in stores.

Goods delivered are payable in full at the time of ordering by credit card, via the Ogone secure site.

In the event of non-payment at the due date, the amount will be increased as of right and without notice by  interest of 12% per annum  and by compensation of 15% with a minimum of €100, representing an irreducible fixed penalty clause, without prejudice to any other damages and interest that might be due.

 

Retention of rights

 The equipment supplied remains the exclusive property of Cartronics until payment and any costs and interest have been received in full.

In the event of late payment, Cartronics retains the right to repossess the merchandise supplied until full payment is received. To this end, the customer gives the vendor formal and irrevocable authority to act.

Delivery

The delivery in Belgium of an order accepted by Cartronics will be carried out within 24 hours (working days) for all orders placed before 15.00 hours. Otherwise delivery will be within 48 hours.

Delivery is invoiced at an additional €6.19 + VAT per item sold. Cartronics reserves the right to revise this amount upwards to reflect transport costs.

 Cartronics shall incur no liability for delivery delays or for the total or partial failure to fulfil orders in the following cases:

  • In the event that the payment conditions stipulated on the order confirmation are not observed by the customer;
  • In the event that the information required for the performance of the order has not reached Cartronics in good time.
  • If the delay or the failure to fulfil the order results from weather conditions, strike, accident, fire, natural catastrophe, civil or foreign war, riot, impossibility of obtaining supplies or delay on the part of Cartronic’s suppliers, or any other cause beyond Cartronic’s control.

Obligations of Cartronics

For all stages of access to the site, Cartronics has only an obligation of means.

Cartronics devotes the greatest care to the creation of the site. Nevertheless, it cannot guarantee the accuracy of the information.

Cartronics undertakes to honour the orders received on the web site only to the extent that product stocks are available and without prejudice to the fact that Cartronics is only bound after express written confirmation of the order. If the product is unavailable, Cartronics undertakes to inform the user as soon as possible.

Liability

Cartronics may under no circumstances be held liable for the consequences and in particular for the losses, of whatsoever kind, arising from the fact that the security, authenticity, confidentiality and/or data integrity of the transactions has been compromised as a result of the violation of security principles.

Cartronics may not be held liable for any disadvantages or losses inherent in the use of the Internet network, including interruption of the service, any external intrusion or the presence of computer viruses, or any act of force majeure.

Cartronics may not be held liable for any direct or indirect losses due to any modification, suspension or interruption of the web site.

The customer is solely responsible for the suitability of the goods it has ordered for the purpose and needs for which they are intended.

The customer declares that it is familiar with the specifications of the goods that are the object of the present sale and has taken all the precautions necessary in the light of its choice.

Under no circumstances may Cartronics be held liable for any indirect losses resulting from the use of the products.

Renunciation - complaints

Pursuant to article 78 of the law of 14 July 1991 on commercial practices, the customer has a period of fourteen working days from the delivery of the order to return the products to Cartronics for exchange or refund, without penalty apart from the costs of return.

The customer must notify its intention of renunciation by email, indicating the reasons.
If the customer makes use of this option, it must return the product supplied to the registered offices of Cartronics at its own costs and risks. It is essential that the products be accompanied by the invoice and the original delivery note. The products so returned must not have been unpackaged, unsealed or used in any manner whatsoever. They must accordingly be returned in their unopened original packaging as originally sealed.  Any opening of the originally sealed packaging will give rise to the presumption that the product has been used. In the event of improper returns, Cartronics reserves the right to refuse a subsequent order, without prejudice to any damages and interests that Cartronics retains the right to claim. The customer can send a request for retraction using the “Contact us” form.

Protection of privacy

For the purposes of the orders, Cartronics collects personal data in order to process the request. These data can also be used by Cartronics for marketing purposes. A customer wishing to oppose this use must so indicate when providing the data. In accordance with the law of 8 December 1992 on the protection of privacy, customers have the right to consult their data and amend them if necessary. Exclusive e-commerce price

The “exclusive e-commerce price” is a special price only applying to an order using the e-commerce module. Delivery only, no collection.

Intellectual property

Pursuant to the Belgian law of 30 June 1994 on copyright and related rights, any reproduction or communication to the public by whatsoever means of any content such as text, sound, images, video or music found on the site is forbidden without the prior express and written consent of Cartronics or the rights holders. Any downloading, copying or scanning of this content is authorised for strictly private consultation only. Any unauthorised use of this content constitutes an intellectual property right infringement and may give rise to legal proceedings and the payment of damages and interest. 

Jurisdiction

The present conditions are subject to Belgian law.  In the event of dispute, the Belgian law shall apply and only the courts of the Nivelles judicial district have jurisdiction.
